Varun booked under National Security Act - Discuss

Varun Gandhi, BJP's latest Hindutva poster boy and its candidate from Pilibhit, plunged into deeper trouble on Sunday night with the Uttar Pradesh government deciding to book him under the National Security Act (NSA) for inciting communal tensions which may result in him being under detention for upto one year.
There are other politicians, who have done worse.. but never been booked under NSA. So, is this trial justified. Discuss. Put in your points.

  1. I think that this trial is justified as politics should not be practised on communal grounds. Its a very good iniative and should be booked against everyone who tried to divide the masses on the basis of their religion and win votes.

  2. the situation behind political stand of varun says it can be purely the publicity oriented as varun is contesting for bjp in this year's elections. also whenever such communal comments are passed they have created riots situation in INDIA, depending on theanti-muslim comments passed by varun he should be booked for 'prompting enmity between different group of people' but at the same time for a speech he can not be booked for 'attempt to murder'which is an exaggerated demand from UP government.

  3. It is indeed a wise step to take and book politicians, who try to divide us on the basis of our religion. But, the concern here is that this step shud be taken without discrimination and should be practiced against everyone who violates it. Politicians like The Thackereys, and Yadavs (Bihar) should not be an exception. they have done worse.

  4. During Election each politician speaks these type of speeches to grab votes.Whatever varun has done is not completely justified but because he is small fish,he did that to grab the votes.
    If you see history many politician has taken similay ways to stand in politics,but due to good support from party no action has been taken against them.Same thing was happening in maharashtra also...

  5. I think, Varun booked under NSA is justified but i had been observing from years that this kind of situation is blown extremely so that people will vote to that party(Here it is BJP),
    One more thing i would like to add is this high profile people will never learn because they dont have fear of what they have done ,they are confident that they will come out of prison/they will come out because they have high level contacts

  6. I too agree with harshil that the case is being hyped to attract more publicity.Since he is being charged under NSA(NSA not yet imposed) he still have 3 options which i think he will definately do it and will come out of the issue cleanly
    1. He can approach the state government to prevent the NSA being imposed on him.

    2. There is a state advisory committee which he can approach. This committee is headed by a sitting judge of the High Court -- two retired judges are also part of the committee. He cannot be represented by a lawyer before this committee.

    3. Since it's a Central government act, he can move a representation to the Union Home Ministry. This has to be ratified by the President.

    And most important is he will challenge the issue in court.

  7. Making any kind of anti-communal statements is not justified. But taking such a harsh action against just one candidate during election times is certainly something we need to ponder about. Why such a strict action was not taken against Raj Thackrey who spread disharmony, led to closing down of Mumbai which caused a lot of state revenue loss? If communalism is not propagated by any party, then why are they choosing only those candidates belonging to particular community to represent that constituency? They do that cause they know its their major vote bank. If Varun Gandhi is being charged and penalized for 'attempt to murder', I believe even the other candidates from past and present must be charged for similar behavior. Let the justice prevail rather than targeting one particular party and one particular candidate.

  8. Not only he will come out of the cases cleanly but also can make a strong hold in the politics. This may affect the minds of Minorities. So in order to continue the Integrity of the Nation GOI should take a firm step in this matter and make counter laws preventing the 3 options(as explained by Evolution) from the reach of politicians.

  9. When People say "GOI" and expect action from from the "GOI" against people going against the Constitution, are these people really aware of what the "GOI" means?? and what does it consist of?? ......
    The answer is it consists of people like Varun Gandhi, L.K. Advani, Arun Gawli, Praveen Togadia, Narendra Modi,and many many more who are strolling the corridors of the parliament because the prisons are too full to make space for these esteemed personalities. If any one thinks that Booking Varun Gandhi under some big title Acts...like(National Security Act... Blah Blah Blah), will make any difference to him or his aspirations to become a member of the parliament, its time to wake up and smell the coffee!. WE gullible people of India (especially the educated class) are so patriotically attached to, and in love with the Judicial System of the most corrupt country on the face of the planet that they gladly accept anything that these criminals and their parties say and start beliving that this "Holy System" of ours will bring People like Varun Gandhi to Justice. (He probably is sitting in some 5 star hotel and having a laugh reading this blog)
    I can bet my life that this man will not be found guilty of anything and will contest the elections and will win!

  10. rahul gandhi shud be treated in accordance with the law of land.if he his guilty under the NSA for his speech he shud be punished.but certainly ammendments shud be made in the law to disallow people like rahul gandhi from contesting the elections for say the nxt 5 yrs or so.this i feel wud be the most severe punishment that can be given to him

The congress being a strong opponent of BJP wont leave a single point against varun gandhi but "Freedom of speech" being our democratic right Varun Gandhi can express his views provided its not hampering our national security. The GOI has always been in favour of Minority (Muslims)in order to maintain peace.
    Similarly Bal Thackeray is also in favour of Hinduism but still the government is criticizing him & his supporters so we feel that NSA should take action against Congress bcoz its hampering Political career of varun Gandhi and if he is not found guilty instead of stepping back he should go for election.

  13. what I feel is that this is a publicity gimmick.No doubt he is guilty and must be punished .But not under NSA. He is a newbie in Politics.His statments came at a wrong time.If these statements wouldnt have come around te election time,this wouldnt have been made an serious issue as it has turned out to be now.And the parties like BSP and Congress will leave no stone unturned to defame BJP so that it doesn't make it to form a government.Dont take me wrong I am not supporting any political party.But If it would have done by some one from BSP/Cong ,BJP would have done the same.However BJP should not allow him to contest elections this time.

  14. varun gandhi speech saying,"If somebody lifts a hand against Hindus, or thinks they are weak, there is nobody behind them, then I swear on the (Bhagvad) Gita that I will cut off that hand".but that does not mean that he is against muslims.he was against people who he felt that some portion of hindus were targeted.varun gandhis speech came into lime light and his speech was sharper because of his surname.. there are many other leaders like raj thakeray,bal thakeray who made their careers by giving controversy speech.varun gandhi is not the only politician who has tried to improve his careers by spreading hate and threating communities.even hindu leaders like uma bharati were booked for controversial speech but were never found guilty.

Varun Gandhi speech saying " “If somebody lifts a hand against Hindus, or thinks they are weak, there is nobody behind them, then I swear on the (Bhagvad) Gita that I will cut off that hand."i agree that what he said is alleged but that does not mean that he was against muslims . he was referring to that specific area where hindus were targeted.ya it might true through his speech he wanted to gain publicity buthe is not the only politician who has tried to improve his career by spreading hate and threating communities.there are other leaders like shiv sena'a bal thakeray and raj thakeray who has made many controversial speeches but never found guilty.

    In my opinion Varun Gandhi to a certain extent is a victim of poitical vendetta.No doubt his comments on the basis of relegion are accepted but still I feel he is a target because of his name "GANDHI" and the undue media coverage.There was a similar incident where the Congress election candidate named Imran Kidwai commented in public that he if he has the power he will impose Fatwa against all the muslim who join BJP and he was only given a warning by the election commission.This is the reason I feel that booking Varun Gandhi under National Security Act is harsh in my opinion.

  18. Before I conclude, I would like to say that India is the 11th most courrupt country in the world; Mexico is most corrupt country.

    As for concluding this discussion, we all agreed that Varun is most likely guilty and should be punished. But we are also of the opinion that NSA is a bit too harsh and that other politicians who have made similar or even worse speeches should also be punished - regardless of the party they belong to.
